Terms and Conditions
I don't like legal stuff any more than you do. However, it's a necessary evil, so let's grit our teeth and get on with it.
The fundamental principle underlying my Terms and Conditions is that I will treat you in the way in which I would wish to be treated when I am a customer myself.
I was a member of the Which? Web Trader's Scheme until its closure in January 2003. I continue to abide by its Code of Practice. Moreover, nothing within these terms and conditions affects your normal legal rights: "Your statutory rights are unaffected".
Terms and Conditions applying to all purchases
Payment
I accept payment by credit card (MasterCard, Visa, Visa Delta, Switch, JCB, Eurocard and Solo), sterling cheque drawn on a UK bank, UK postal order or sterling international money order. If you pay by cheque, your order will not be dispatched until your cheque has cleared. Please note that if you pay by credit card, I will deliver only to the cardholder's address.
I regret I cannot accept payment using Electron or Maestro cards.
Prices
The prices of prints and cards are fixed. I guarantee that they will not change between the time you order the goods and the time you pay for them. Retouching prices are estimates. If the estimated price exceeds the actual cost of the service or goods, I will charge you the actual, lower price. If the estimated price is less than the actual price, I will offer you the opportunity to cancel your order without penalty.
Delivery
I expect to be able to deliver your order within twenty-eight days. If this is not possible, I will let you know that this is the case at the earliest opportunity and advise you of when I will be able to fulfil your order. At this point, you will have the option of cancelling your order without penalty and receiving a full refund of any charges that I have already made.
Prices exclude delivery, which is charged separately. The cost of delivery depends on the value of your order and the place of delivery: however, wherever you are in the world, there is a minimum order value that will qualify for free delivery. In addition, you may opt to pay for additional or quicker delivery services (such as guaranteed next day delivery within the UK). Again, there will be a minimum order value that will qualify for these services (where they are available) without charge. You can obtain complete information on my delivery charges here.
The delivery charge for each individual order is shown on the online order form and you will be able to see what, if any, delivery charges will be made before any charge is made to your credit card.
Licencing fees will be agreed in advance. They will depend entirely on the scope and duration of the licence.
All prices quoted on this web site include UK VAT at the current rate of 17.5%. VAT is payable on all purchases made by customers residing within the European Union. (Residence is defined by the country within which delivery is made.) For non-EU customers, VAT is not payable, and will be deducted from your order before payment. Liability for VAT is determined by the delivery address. For your information, the VAT-free price of my standard products is given below.
Non-EU customers will see the VAT-free price displayed on the checkout pages.

International customers are liable for all other taxation and import duties that may be payable.
Currencies
Prices on my product pages are displayed in pounds sterling. However, credit card users may choose to pay in Euros, US dollars or, of course, sterling. Because exchange rates vary constantly, and differ between banks and credit card providers, it is not possible for me to display prices in other currencies within the shop. However, once you are at the checkout, you can choose to settle your account in one of the other currencies if you wish. At this point, the equivalent price in your chosen currency will be displayed.
If you choose to pay by cheque, then the cheque must be in sterling and drawn on a UK bank.
Complaints and Disputes
In the unlikely event that you are dissatisfied with my services, please let me know. I will acknowledge your complaint within 5 working days, and then do my utmost to ensure that the matter is resolved in a mutually acceptable way. You will be kept informed throughout the resolution process. I expect that most disputes could be resolved within twenty-eight days.
I do not belong to any Ombudsman or other regulatory scheme. However, I encourage you to pass on any comments you have about the quality of goods and services you receive from me (either good or bad) to myself, or (where relevant) to my ISP, Hazelnet.
All contracts between Tile Barn Photographic and yourself are governed by English law. Any guarantees offered or conditions imposed in these terms and conditions do not affect your statutory rights.

Terms and Conditions applying to the purchase of prints
Refunds
If you are in any way dissatisfied with one of my prints, for whatever reason, simply return it to me in its original packaging, within thirty days of delivery, and you will have the choice of a replacement or a full refund of the cost of the print (and frame, if applicable). Alternatively, you may notify me of your desire for a refund or replacement using any of the methods listed on my contacts page to discuss a mutually acceptable way to proceed. This is a no questions, no quibble refund.
Your purchase of a print gives you the right to display the image for non-commercial purposes. That is to say, you may not use the image in any way that provides you with a direct or indirect gain. If you wish to use or publish the image in any other way, please contact me to discuss licensing arrangements.
Copyright
Your purchase of a limited edition print or an unlimited print does not transfer the copyright of the image to you. I retain the copyright and exert my right under the Copyright, Designs and Patents Act 1988 to be identified as the author of the image.
I guarantee that, provided your print is displayed in standard conditions* or better, no noticeable fading will occur within the time spans listed in the table below. If fading does occur, simply return the print, in its frame and with a photograph of the print in its normal display setting, to me at my usual address. If I agree that the print has faded, I will replace the print and refund your costs. If you are considering making a claim under this clause, it would be helpful if you were to contact me in advance to discuss the problem.

* Standard conditions are: behind non-reflective glass, indoors, at an average temperature of 75°F or less, a relative humidity of 60% or less, and exposed to light with an average intensity of 450 lux or less for an average of twelve hours or less per day. (Whew!)
NB: A conventional colour photograph is likely to show noticeable signs of fading in less than twenty years.

Terms and Conditions applying to the purchase of greetings cards
Refunds
If you are in any way dissatisfied with my greetings cards, for whatever reason, simply notify me within seven days of delivery. You will have the choice of a replacement or a full refund of the cost of the card(s). You will receive your refund within thirty days of making your request. Depending on the reasons for your dissatisfaction, I may request that you return the cards to me. If I make such a request, and you do not return the cards within thirty days, I am entitled to make a charge to reflect the cost of collecting the goods from you and deduct this amount from your refund.
Data protection
If you have any questions or concerns regarding my data protection policies, please contact me using any of the methods listed on my contact page.
The names, contact details and order histories of my customers and newsletter subscribers are stored in a database on my computer system. The only information that is collected is that which is provided during the ordering or newsletter registration process. This information is collected by myself, not by any third party, and is collected solely for the purpose of fulfilling your order or providing you with information about my site and the services I offer.
I do not send out any marketing information by any means other than my email newsletter. To receive the newsletter, you must subscribe to it. (That is to say, I do not send out any unsolicited newsletters.) Subscription is free.
The information I collect will not be divulged to third parties unless I am required to do so by law. I do not store the credit card details of my customers in electronic form; nor do I have access to credit card details supplied as part of the online ordering process at any time.
Online security
Security during the online ordering process is provided by WorldPay. These transactions are encrypted using 128 bit Secure Socket Layer (SSL) architecture (dependent on browser support), and are signed using Thawte digital certificates.
Other online activity, such as newsletter subscription and general email correspondence, is insecure. However, if you would like a more secure means of online communication, you may download by own public key here. If requested, I will sign any future emails to you. You may also ask me to encrypt any future emails to you as well. Please remember that if you do this, I will need your own public key before I can comply.
